Known Problems with the Breathalyzer

When you are suspected of drunk driving, the arresting officer may ask you to submit to a Breathalyzer test. In this test, you are asked to blow into a machine that will give the officer a reading of your Blood Alcohol Content (BAC). The biggest problem with this machine is that it is notoriously inaccurate.

Even if your BAC is actually under the legal limit, you can still fail the Breathalyzer due to:

  • Acid reflux
  • Consumption of bread
  • Radio frequency interference
  • Poor Breathalyzer calibration or maintenance
  • Abnormal breathing patterns
  • Other physiological issues
